General Terms and Conditions for Purchases in the Online Shop at www.shop.debeaufort.ch



1 General, Scope of the GTC


1.1   All deliveries and services shall be provided exclusively on the basis of the following General Terms and Conditions, hereinafter referred to as "GTC", in their version valid at the time of the order.

1.2   The contractual partner is the sole proprietorship Luzi de Beaufort with Luzi de Beaufort as the contact person, hereinafter referred to as the "Seller".

1.3   Customers within the meaning of these terms and conditions may be consumers, hereinafter referred to as the "Customer". Consumers within the meaning of these terms and conditions are natural persons who enter into legal transactions for purposes that are predominantly neither commercial nor attributable to their independent professional activity.


2 Conclusion of Contract, Formation of the Contract


2.1   Our offer is binding. By placing your order, you accept our offer to conclude a contract. The contract is formed upon submission of your order to us. You will receive an order confirmation and invoice via e-mail.

2.2   Once you have found the desired product, you can view it in more detail without obligation by clicking on the product name or product image. By clicking the [ADD TO CART] button, you can place the item in your shopping cart. You can view the contents of the shopping cart at any time without obligation by clicking the [Shopping Cart] button. You can remove or change products in the shopping cart by adjusting the quantity and clicking the [DELETE] button. If you wish to purchase the products in the shopping cart, click the [CHECKOUT] button on the "Shopping Cart" page.
During the subsequent checkout process, you will set up a customer or guest account for your first purchase and select the shipping and payment methods. In the penultimate step, under "Confirmation", you will see an overview of your order details where you can review all information and modify it by clicking "edit". You can also correct input errors by navigating backward in your browser or by canceling the checkout process and starting over. To complete the purchase, you must press [Buy]. By pressing the [BUY] button, you accept our General Terms and Conditions and submit your order to us.


3 Storage of the Contract Text


We store your order, the entered order data, and the complete text of the contract. We will send you an order confirmation and invoice containing all order details and the full contract text via e-mail.


4 Right of Withdrawal for Consumers


Swiss legislation does not grant the customer the right to change their mind and return a product after an online purchase. However, if you are unsatisfied with your purchase, please contact us within 14 days from the order date. We will make every effort to find an amicable solution.


6 Prices and Shipping Costs


6.1   For customers from Switzerland and the Principality of Liechtenstein, all stated item prices are in Swiss Francs (CHF) including the statutory Swiss Value Added Tax (VAT), plus shipping costs.

6.2   For customers from abroad (Germany, France, Italy, Austria), Swiss VAT will be deducted (tax-free export delivery). However, deliveries to these countries may be subject to local import duties (e.g., customs duties, import turnover tax, or postal clearance fees). These costs shall be borne by the customer and paid directly to the responsible local customs or tax authorities.

6.3   We deliver by default with Swiss Post. If you prefer another carrier, we kindly ask you to arrange a pickup at our location through the provider of your choice.


7 Delivery Conditions


7.1   We deliver exclusively within Switzerland, and to Liechtenstein, Germany, France, Italy, and Austria.

7.2   For destinations in Switzerland and Liechtenstein, the goods will be shipped within 3-4 business days after receipt of payment, unless otherwise stated in the offer, and delivered within 3-4 days after shipment. We do not provide binding delivery times for destinations outside of Switzerland and Liechtenstein. If you require an estimate, please check with Swiss Post or the carrier of your choice, provided you have arranged a pickup. The delivery time specified in the offer refers to deliveries within Switzerland.


8 Payment Conditions, Cancellation


8.1   Ordered goods will strictly only be delivered after full payment has been received (advance payment). Bank transfer or cash payment are accepted methods of payment.

8.2   Customers from Switzerland and Liechtenstein shall settle the invoice amount in Swiss Francs (CHF). Customers from the remaining foreign countries (Germany, France, Italy, Austria) shall settle their online purchase via advance bank transfer by SEPA payment in EURO (EUR) according to the current exchange rate of their bank on the day of payment.

8.3   If an order is not paid within ten (10) days after receipt of the order confirmation, the unpaid order will be automatically canceled and the reserved goods will be released for sale again.

8.4   The goods remain our property until full settlement of the invoice amount.

8.5   During the period of default, interest shall be charged on the purchase price at a rate of 5 percentage points above the base interest rate.


9 Warranty


If you are a consumer, the warranty is provided in accordance with statutory provisions.


10 Liability


We assume unlimited liability for intent and gross negligence as well as in accordance with the provisions of the Product Liability Act. In cases of slight negligence, we shall be liable for injury to life, body, and health of persons.
In other cases, we shall only be liable for slight negligence if essential contractual obligations are breached. Essential contractual obligations are those whose fulfillment makes the proper execution of the contract possible in the first place and on whose compliance the contractual partner relies. Liability for the breach of such an essential contractual obligation is limited to the foreseeable damage typical for the contract, the occurrence of which we had to expect at the time of conclusion of the contract based on the circumstances known at that time. This limitation of liability also applies to the benefit of our vicarious agents.

12 Miscellaneous


12.1   The contract languages are German and English.

12.2   The European Commission provides a platform for online dispute resolution. This can be accessed via the following internet address: https://europa.eu. We are neither willing nor obliged to participate in dispute resolution proceedings before a consumer arbitration board.

12.3   If one or more provisions of these GTC are or become invalid, the validity of the remaining contract shall remain unaffected. Insofar as provisions are invalid, the content of the contract shall be governed by statutory regulations.
